Регулювання приватної військової та охоронної діяльності: порівняльний аналіз політики міжнародних організацій і світових держав

В статті розглянуто регулювання приватної військової та охоронної діяльності. Проведено порівняльний аналіз політики міжнародних організацій і світових держав. Приватна військова та охоронна діяльність є дуже багатогранним, гнучким і неоднорідним явищем системи міжнародних відносин.
Провівши дослідження можна зазначити, що коли мова іде про інтереси «сильних» держав (наприклад, США, Велика Британія), то приватна військова та охоронна діяльність постає, як інструмент політики в руках держави більшою мірою, ніж як самостійний та неконтрольований механізм. Приватна військова та охоронна діяльність здебільшого не становлять загрози національному суверенітету держави тому, що значною мірою ця діяльність залежать від інтересів держави і потреби у реалізації державних інтересів з їх допомогою. Коли йдеться про держави з нестійкою державністю, слабкими інститутами влади та соціального контролю (Афганістан, Ірак, деякі країни Африки та Латинської Америки та інші), приватна військова та охоронна діяльність стає актором, здатним конкурувати з силовими інститутами таких держав у сфері забезпечення безпеки. Практика регулювання приватної військової та охоронної діяльності складається на національному, регіональному, а сьогодні вже і на глобальному рівнях, що свідчить, по-перше, про назрілу потребу врегулювати статус приватної військової та охоронної діяльності з погляду міжнародного права, а по-друге – про усвідомлення значущості зміни сприйняття приватної сфери військово-силового бізнесу як звичайного ринку комерційних послуг. Проаналізовані міжнародні ініціативи, покликані кожна по-своєму врегулювати питання статусу приватної військової та охоронної діяльності, відрізняються гнучкістю трактувань цього феномену, і вони розглядають взаємодію ПВК не тільки з державами та міжнародними організаціями, але включають в орбіту регулювання також і інших взаємодіючих з приватною військовою та охоронною діяльністю акторів міжнародних відносин («Швейцарська ініціатива»). Однак жодна з ініціатив на сьогоднішній день не є ні ідеальною, ні завершеною. Робота над точністю формулювань і вірністю розуміння феномену приватна військова та охоронна діяльність продовжується і з часом знайде своє відображення в документах.
